General terms & conditions

This site is owned and operated by Escalade International Limited("Escalade Sports International Limited", "we" or "us"). Registered office: Escalade International Limited, Pleasant View Road, Penllergaer, Swansea SA4 9GE. Registered number 03735986 (England and Wales). Whilst every effort has been made to ensure that the information contained on this website is accurate and up to date, Escalade International cannot be held liable for any errors, omissions or price changes.

Due to continuous product development specifications may change without prior notice and we may substitute a product for one of similar or better quality - please confirm upon order. All products are subject to availability.

Please consult your Doctor before using any product.

All images on the website are for illustration purposes only & to give a general guide of how the product may look once assembled. The actual product may differ slightly to that in the illustration.

All discontinued products are delivered flat packed and will require assembly by you. Installation is available at an extra charge. Contact us for charges on 0115 9820122.

Normal delivery time is 7 to 10 working days. You will be contacted by our delivery team and given an am/pm slot.

Free delivery

All orders are free delivery to mainland UK addresses, excluding (but not limited to) the following postcodes: BT, HS, IV, AB, PH, PA, DD, KW and all offshore postcodes.

How to order

Please note that in all cases we must have a contact telephone number for you. We will not be able to process your order without this information.

We have three methods for you to place your order - telephone, mail, and through this web site.

All orders must be paid for in full before they will be despatched. This includes any item that is put on backorder for you because it is out of stock.

Payment is necessary so that we can allocate the incoming stock to your order. If you do not wish for payment to be taken for backorder items, we will be able to leave the item on back order for you, but we cannot guarantee that there will be free stock available to fulfill your order.

Telephone orders

Telephone orders can be placed Monday to Friday 9.00am to 5.00pm. Have your order and credit card details ready. When placing your order by phone, you will be given an order number, which you need to keep for future reference.

Internet orders

Log onto www.fitness-equipment-clearance.co.uk and follow the online instructions. Please Note: Escalade Sports is at present unable to accept orders from Overseas on the website. If you require assistance or a specific quote for shipping overseas please call us on 0115 9820 122.

Credit card orders

If you are ordering by credit card the goods must be sent to the cardholders registered address.

Distance selling regulations

Under the Distance Selling Regulations you have a right to cancel your order (prior to shipment, see cancellation terms below) for any item purchased on this website, for a full refund. This does not apply to Special Order items or items made to your specification.

Specific delivery date orders

It may be possible to request delivery for a specific date. Escalade International will endeavor to make this happen but it cannot be guaranteed. Escalade International will not entertain any claim whatsoever for compensation arising from late delivery due to a third party carrier.

Order cancellation/ refused deliveries (see also Exchanges/Returns)

You may cancel your order for a full refund prior to your order being shipped. If you cancel your order after it has been shipped, you are responsible for any and all freight charges incurred by Escalade International. Any unpaid freight charges will be deducted from your refund. If you refuse to accept delivery of your order for any other reason than the product being damaged in transit, you are liable for all outward and return freight charges incurred by your refusal. If it is found that any of the larger products upon delivery 'will not fit' through any doors/stairwells and the product is subsequently returned/refused, you are responsible for all outward & return carriage costs. Please also see 'Restricted Access' terms. We would therefore recommend that you ensure the product will fit and can be transported to its point of installation easily. If you need to confirm the boxed dimensions of a product please call Accell Fitness UK prior to placing your order.

Restricted access

Due to the size of some delivery vehicles, Escalade International MUST be informed of ANY restrictions regarding access for the delivering vehicles. This includes but not limited to, steps (including those required to climb to gain access to the property entrance), any overhanging/low trees/shrubs, steep driveways, narrow lanes, tight bends or any other restrictions that may make it difficult for the delivering vehicle to gain access to the point of delivery. Escalade International will not accept any claims for compensation arising from non/failed/refused delivery of any item where the carriers or we were not made aware of any points regarding access restrictions. In the event that the item is refused/cancelled due to these restrictions, the customer is liable for all carriage charges.

Delivery terms

Please note: Due to Health & Safety regulations upstairs deliveries are at Escalade International's discretion and are not guaranteed. This includes (but not limited to) steps that are immediately outside the premises, which are required to climb in order to gain access to the property.

Delivery

All orders are processed and shipped in the order that they are received. Normal delivery time is up to 10 working days and you will be contacted by our delivery team and given an am/pm slot. A card will be left if no-one is home & the goods returned to our warehouse to await your contact. All deliveries are made Monday - Friday between 8am & 4pm. Escalade International are unable to give specific times for delivery.

Shortages or damages

When the delivery team bring your order you MUST count the pieces you receive & look for any damage. It is noted on our delivery note, the number of boxes you should receive. If the number of boxes you receive does not exactly match the number of pieces on the delivery note, you MUST note the number of pieces you received on the delivery note by your signature. Damage to the equipment / packaging MUST be noted on the delivery note next to your signature. THE WORDS “UNEXAMINED” OR “UNCHECKED” WILL NOT BE ACCEPTED AS A CONDITIONAL SIGNATURE. You must cross out “delivered in good condition” from the carrier’s delivery note. It is very important to check your order. A signature is an acceptance that you have received the whole order in good condition. Any shortages or damages must be reported to Escalade International within 48 hours of signing. Escalade International cannot be held responsible for shortages or damages if you do not note them on your delivery note. This does not affect your statutory rights in the event of the goods being faulty. All damage and shortage claims must be filed with Escalade International. Collections/faulty products

In the event of an item being received that either develops a fault (proof of purchase will be required) or is found to be faulty upon delivery, please contact our Customer Support Centre on 0115 982 0122.

Exchanges or returns

Our exchange and return policy is simple. If within your 7 day home approval you wish to return or exchange an item, Call 0115 9820 122 am to 5pm Monday through Friday, to obtain a Return Authorisation Number. Escalade International will then contact you to arrange a collection date. (No returns or exchanges will be accepted without this authorisation number). All returns and exchanges must arrive in like new condition in the original boxes. You will be charged for items received back that when inspected have been found to have been used. Refunds will be obtained on completed returns only.

Installation

If you require installation on a product / products, the time between order & installation may be longer than for that of delivery only.

We will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances.

It is imperative that the space for the product/s has been cleared & that access is unrestricted. We must be informed at the time of placing the order where the product/s are to be installed. All prices quoted are for ground floor installations in the main building of the property or a garage at side of the main part of the building. Installations above or below ground floor or outside the main building i.e. an outhouse etc may be subject to surcharge, especially if not mentioned at the time of order. You may be asked to assist the installer to get the product/s to their location, if no help is available then a 2 man installation may be required at extra cost.

Escalade International are within their rights to refuse any installation if the installer deems the installation location to be hazardous or the request unreasonable. If the product does not fit into the area where the installation is requested & a representative of Escalade International did not measure the area, then Escalade International cannot be held responsible, therefore the customer will incur the cost of the visit. Agreed installation times must be adhered too.

Adequate parking / vehicle access must be provided by the customer. It is the customer’s responsibility to check that the installation has been carried out to their satisfaction. If the customer is not present when the installation is completed the installation will be deemed as completed to the customers satisfaction. Any subsequent visits that may be required will be chargeable at the same rate as the first visit.

WEEE (Waste Electrical and Electronic Equipment) Regulations



Each EU Member State now has a legal obligation to minimise the disposal of WEEE in landfill sites.

The broad aim of the WEEE regulations is to address the environmental impacts of electrical and electronic equipment when it reaches the end of its life.

We all have a responsibility to contributing to the reuse, recycling and other forms of recovery of WEEE under these Regulations

Over 75% of waste electrical goods end up in landfill, where lead and other toxins contained in the electrical goods can cause soil and water contamination which can lead to negative effects on human health and the environment.

Electrical and Electronic Equipment that was made after 13th August 2005 should display the crossed-out wheelie bin symbol on the packaging or product. The purpose of the symbol is to encourage householders to dispose of their WEEE separately from household waste.

What can you do?

Reuse

If your old machine is still working, do you know somebody who would like to use it? There are many organisations such as schools, clubs, residential homes etc. who would be very happy to have the use of your old equipment.

In addition there are organisations that will reuse and repair electrical and electronic equipment, and some even run "cash for recycling" schemes.

Recycle

If your old equipment is no longer useful, please recycle it.

Alternatively, as a distributor we are committed to reducing the amount of WEEE that goes into land fill. We are doing our bit for the environment by offering to collect your old product for disposal when you purchase a new machine from us. This means, for example that if you buy a new cross trainer you can return your old cross trainer to us and we will arrange appropriate disposal of it for you free of charge. (Please note it must be a similar product - e.g. an old exercise bike for a new one, an old crosstrainer for a new one. You should also note that the product must be of a similiar size to the new product being purchased). There is a collection fee of £20.00, inc of VAT, that applies to this collection service.This must be arranged with us at the time of placing an order with us for the new product.

 

Fitness equipment hire - rental terms and conditions

1. Definitions and Law
The hired item(s) as agreed in the signed delivery note are hereinafter referred to as the Escalade International. is the Owner and Renter of the Equipment and is hereinafter referred to as the Owner. The customer named on the delivery note is hereinafter referred to as the Hirer. The law of England shall govern the rights and obligations of both parties to this contract.

2. Basis of Charging
The Hirer will pay the hire charges shown overleaf which will commence from the time and at the rate(s) shown overleaf and continue during the term until the Equipment is restored to the Owner in a clean and serviceable condition against the Owner's receipt. All charges are payable on demand, and include Value Added Tax at the prevailing rate on the date of invoice.

3. Minimum period of Contract
The contract will terminate not earlier than 4 weeks from the commencement date unless the contract is based on a short term agreement between both parties. A Commercial contract will terminate not earlier than 26 weeks from the commencement date, unless previously agreed in writing by both parties. If the Equipment is returned to the Owner before the minimum period has expired, the minimum term cost must be paid.

4. Responsibilities of the Person Signing
The person signing the contract warranties that he/she has the authority of the Hirer to make this contract on the Hirer's behalf. The Hirer hereby indemnifies the Owner against all losses and costs that may be incurred by the Owner if this is not so. The Hirer hereby acknowledges that instruction has been given in the operation and use of the Equipment. The Hirer hereby undertakes to ensure that no-one uses the Equipment who is not properly instructed and shall not allow the Equipment to be misused.

5. Delivery in Good Order
The Hirer, having been afforded an opportunity to inspect the Equipment agrees that it is hereby deemed to be in good working order and wholly free from visible and/or reasonably ascertainable damage at the time of delivery. Any damage on delivery must be noted overleaf and signed by both the person signing the contract and the Owner or driver.

6. When the Signature becomes Operative
Where, for administrative convenience, the Hirer is requested by the Owner to sign a contract and/or delivery note before the goods are handed over, the Hirer agrees to examine the goods at the time of physical hand over and the effect of such signature will not become operative until immediately after the physical hand over.

7. Responsibility of the Owner
The Owner will indemnify the Hirer against all breakdown and maintenance of the Equipment whilst on hire unless it becomes damaged beyond acceptable wear and tear, in which case the Owner shall replace such Equipment. Public Liability insurance will be in force for all users (with the Hirer's express permission) over the age of 18 years. Any damage caused solely by the Owner or Agent while moving the Equipment must be rectified at the Owner's expense.

8. Responsibility of the hirer - Third Party
The Hirer shall at all times and in all respects indemnify the Owner against and from, any and every reasonable expense, liability, loss claim or proceeding whatsoever incurred by it in respect of any personal injury whatsoever (including but without prejudice to the generality of the foregoing, injury to the hirer and injury to any servant, employee, relation or agent of the Hirer) and in respect of damage to any property whatsoever (including the Equipment) arising out of, or in connection with, or consequent upon the hire, delivery, use, misuse, non-use, repossession, collection return or non-return of the Equipment or any part thereof, provided that such indemnity shall not extend to circumstances where the Owner or its employees, servants or agents have acted negligently or in breach of these General Conditions or where such injury results from Equipment which is faulty or not fit for purpose.

9. Extended Hire
When the initial charge period has passed, the hire is assumed to continue, unless the Hirer informs the Owner that the hire is ending. In order to prevent unpaid hire, the Hirer agrees to pay for any extended hire period by a method agreed by both the Hirer and Owner. Should any hire remain unpaid for over thirty days from the date of invoice, the Hirer authorizes that the outstanding payment be taken by either the credit or charge card used for the initial payment, or by the method chosen by the Hirer and shown on the Owner's payment authorization form.

10. Electrical Equipment
Where the Equipment comprises electrical components in part or in whole the same should be used with plugs and sockets as provided by the Owner, but if temporarily replaced with other suitable plugs or sockets, this must be carried out by a qualified person. Under no circumstances should the Equipment be used without earthing unless it is of double insulated construction.

11. Maintenance of equipment and breakdown Procedures
The Hirer shall keep them acquainted with the state and condition of the Equipment and ensure that it remains safe, serviceable and clean. Any breakdown or any unsatisfactory working of the Equipment must be immediately notified to the Owner. Under no circumstances must the Hirer repair or attempt to repair the Equipment, unless authorized by the Owner. When it is necessary to visit the Hirer's premises, the Hirer agrees to pay carriage if it is deemed that the breakdown is a result of incorrect usage or vandalism.

12. Removal of Equipment
Equipment must not be removed from the address specified by the Hirer when the Equipment was delivered (or collected from the Owner) without the authority of the Owner, or from any subsequently authorized address, without the express permission of the Owner.

13. Lost, Non-returned, Damaged or Unclean Equipment
The Equipment must be insured against fire and theft by the Hirer whilst on hire at the address specified overleaf or subsequently approved by the Owner. When the Equipment is lost or stolen or cannot be retrieved by the Owner, the hire will be deemed to end when the Hirer pays to the Owner the current market retail value of the Equipment. The Hirer agrees to pay the Owner all costs incurred by the Owner in rectifying the condition of the Equipment returned damaged or unclean (allowing for normal wear and tear). Hire charges will continue until such rectification is complete.

14. Determination of Hire
The Owner and/or the Hirer shall be entitled at any time and for any reason whatsoever, without explanation, to terminate this contract (such termination to be effective 14 days after notice of termination has been received by the Owner or Hirer, as applicable) and in the case of the Owner, to repossess the Equipment or any part thereof. The Hirer agrees that all balances owed to the Owner will be paid within 14 days of termination of the hire, including all balances relating to the purchase of the Equipment, if any (post hire). Should outstanding hire charges be unpaid beyond 30 days from the invoice date, the Owner reserves the right to charge interest on the outstanding balance at a rate of 5% per calendar month.

15. Rights of Access
The Hirer hereby authorizes the Owner, upon production of this document or appropriate identification, to enter upon any premises (during normal business hours in the case of the Equipment being kept in a commercial property) wherein the Owner reasonably believes any Equipment, or part thereof, to be, and if, and in so far as, the Owner in his absolute discretion deems necessary, to inspect, test, repair replace or repossess the same, under the terms of these General Conditions.

16. Separate Term Validity
Should any term in this contract be held to be invalid, such invalidation will not affect the validity of the remaining terms.
